Rules For Landlords To Be Aware Of

For those who own property in California and rent them out, there have been significant changes to how landlords are supposed to handle new tenant screenings.

Per California Fair Housing law policies, landlords can only deny a tenant’s application due to financial reasons. Ex: low credit score, not enough savings in the bank account, and/or no sufficient income.

When it comes to pets, landlords can still ban pets on their properties. However, a landlord cannot deny a tenant an application for having a service pet or emotional support animal (By definition, an animal that is deemed an assistance animal is not a “pet.” (2 Cal. Code of Reg. (“CCR”) §12005(d)).

For those of you who are landlords in CA, it’s extremely important that you abide by the rules or it could cost you heavy fines. If you have any questions about renting out your property, reach out to me for further discussion.


Non-Warrantable Condo Loans

There might be times as a homebuyer that you will like a condo but its building doesn’t qualify for any standard loan. Here are reasons why a condo building may not qualify for traditional financing:

  • The project is still under construction
  • The development includes commercial space
  • One person owns more than 10% of the units
  • Most of the units have more tenants than owners living in them
  • The community allows short-term rentals
  • The developer has not turned over the control of the HOA to the owners
  • The property is involved in litigation

This is when a non-warrantable loan is needed to purchase the unit in that building by specific lenders. With a non-warrantable loan, you will need at least 20% down payment and the interest rate is higher.
